None of that protects your family from DeKalb County Probate Court. Georgia probate can take 9 to 18 months. It can cost around $15,000 in fees. It does not matter if your home sits inside the City of Atlanta or in unincorporated DeKalb County. Either way, DeKalb County Probate Court decides who can touch your home and accounts. That lasts until a judge says otherwise.

It needs years in place before it works, though. The clock starts the day you sign it, not the day care starts. Building one early, while your parent is still healthy, is what makes it work.

A revocable living trust protects things you own by yourself, like your home and your savings. Running a private practice or a side business is different. Your trust does not say who takes over that practice if something happens to you. A separate paper handles that instead, usually a buy-sell agreement or a succession plan. Many Emory doctors and professors run a private practice or a consulting business next to their main job. That paper works alongside your family trust. Your trust still covers your home and your savings. The practice needs its own plan.

Signing a trust does not pull your cryptocurrency into it by itself. A trust only controls the accounts you list inside it by name. Most people set up a wallet once and forget to add it later. If your family does not know an account exists, they cannot claim it. Give your executor written power to find and reach your crypto holdings. Keep your passwords somewhere apart from your will. A Financial Power of Attorney lets someone you trust manage your money right away. This helps if you get sick or hurt. A Healthcare Directive does the same job for your medical care. Without both papers, your family may have to ask a judge for help instead. That means a guardianship case, or a conservatorship case. A conservatorship covers your money and property. A guardianship covers your daily care. Both are public court cases. Both can take months. Both can cost real money. Sign both papers now. Your family can then act for you right away, with no courtroom involved.

Moving your home’s title into a trust does not trigger a special review. That review is called a Certificate of Appropriateness. It only kicks in for an outside change, like new siding, a new fence, or an addition. DeKalb County or the City of Atlanta runs it, based on where your home sits. Placing your home into a trust is only a paperwork change. It changes who legally owns the title. It does not touch the house itself. A future renovation still needs its own Certificate of Appropriateness, the same as if you owned the home yourself.

A federal Thrift Savings Plan account does not pass through your will. It pays out to whoever is named on your TSP-3 form. That is true no matter what your will says or how recently you updated it. If that form still names an ex-spouse, or someone from years ago, the TSP pays that person. It will not pay the family you intend today. We check your TSP form as part of building your plan. That way it actually matches what you want.

An Emory 403(b) account has its own beneficiary form. Fidelity or TIAA holds that form, depending on which provider you chose. That form controls where the account goes. It works apart from your will or trust entirely. Many employees fill it out once, during onboarding, and never look at it again. We pull that form into your plan. Then we check it against what you actually want today.

Georgia charges no state estate tax and no state inheritance tax on what you leave your family. Only a very large estate would ever owe the federal estate tax. That tax exempts $15,000,000 per person as of 2026. Almost no Druid Hills family comes close to that number. The real risk for most families here is not a tax bill. It is the time and cost of DeKalb County Probate Court. A trust is what actually avoids that.

A will from another state is still generally valid in Georgia. It is still worth a real review once you move here for an Emory or CDC job, though. State laws differ on witness rules, executor rules, and how property splits without a will. Many people who move for one of these jobs also buy a new home here. They open new retirement accounts here too. An old out-of-state will was never written to cover any of that. A quick review shows whether your plan still works in Georgia, or needs an update.

Medicaid and SSI both cap how much money a person can have. In 2026, the SSI limit is $2,000 for one person. If you leave money to your child through a regular will, it can push them over that limit. Then they lose their benefits. A special needs trust holds money for your child without counting against that limit. Your child can still use the trust money for things Medicaid and SSI do not pay for, like therapy or a caregiver. This has to be part of your plan from the start. It does not work if you add it after benefits are already at risk.
