What the Decree Doesn’t Fix

Georgia law (O.C.G.A. § 53-4-49) automatically revokes any gift to an ex-spouse named in a will once the divorce is final. That protection stops there. It does not touch beneficiary forms on life insurance, IRAs, or 401(k)s. If your client’s ex-spouse is still listed on one of those accounts, that ex-spouse gets the money when your client dies, not the kids.

A QDRO divides the retirement account at divorce. It does not update who inherits what’s left in that account later. Clients walk out of your office thinking the divorce "handled" their estate plan. In most cases, it only handled part of it.

Send us a client after their divorce is final and we handle the rest. We update the will, the trust, the power of attorney, the healthcare directive, and every beneficiary form that needs a new name on it. We respond within 24 hours and quote a flat fee before any work starts.

We don’t touch custody, support, or property division. Those stay in your practice. When a client of ours is going through a divorce and needs representation, we send them back to you. No referral fees on either side, Georgia Bar Rule 7.3(c) doesn’t allow it, and this partnership isn’t built on them.
