A revocable trust that was never funded is the most common estate planning failure financial advisors run into. The client paid an attorney to draft it and signed it. They never retitled the brokerage account, the real estate, or the business interest into the trust’s name. When the client dies, those assets go through probate anyway, the exact outcome the trust was supposed to prevent.
Beneficiary designations on IRAs and 401(k)s override the will and the trust. A form filled out at account opening can name the wrong person. If it still lists an ex-spouse or the estate, that account goes to the wrong person, no matter what the will or trust says. When that happens, heirs often liquidate and split the account with whichever advisor is easiest to reach, and it is rarely you.
