A life insurance payout named to "the estate" instead of a person or trust doesn’t skip probate, it walks straight into it. That’s the opposite of what most clients think a policy does. The payout gets tied up for months, is exposed to creditor claims, and becomes public record along with everything else the estate owns.

This happens more often than agents expect. A client buys a policy, names "my estate" as beneficiary because no one is set up yet to receive it directly, and never comes back to fix it. Years later, that policy is the one asset in the whole plan that still ends up in probate court, the exact outcome the coverage was supposed to prevent.

Long-term care policies raise a different problem. A long-term care benefit often needs someone already named to manage the money once it starts paying out. Without that person in place, the family has to ask a judge to appoint one, before your client can even use the benefit. That process, a guardianship or conservatorship case, can take months the family doesn’t have while care costs are already piling up.
