In Georgia, a property held in the owner’s own name, with no trust, goes through its own probate proceeding when the owner dies. Own three rental properties with no trust, and a family can end up managing three separate probate cases at once. Every one of those cases can take 9 to 18 months before the property is free to sell.
An LLC doesn’t fix this by itself. If the owner dies and the LLC membership interest isn’t held in a trust, that membership interest still goes through probate, even though the LLC itself keeps existing. The entity survives. The ability to sell what it owns doesn’t, not until probate closes.
